Public offer
This revision is effective from 01.01.2026. The document is a public offer: by accepting it you enter into an agreement with the operator on the terms below.
1. General provisions
1.1. These Terms of payment services for individuals (the “Terms”) constitute an offer by MAKS SISTEMLARI PLUS LLC (the “Operator”) addressed to individuals with full legal capacity who have reached the age required to perform obligations under the agreement (the “Payer”).
1.2. The effective revision of the Terms is published at exezine.az and is available for review before a payment is made.
1.3. Acceptance takes the form of ticking the consent box on the payment page or pressing the “Pay” button (or an equivalent action). Acceptance means full and unconditional agreement with the Terms.
1.4. The fact of acceptance is recorded in the Operator’s systems and may be used as evidence in disputes, including in court.
1.5. The Operator may amend the Terms. A new revision takes effect on the date of its publication on the site and applies to payments made after that date.
Definitions
- Authorisation — the issuing bank’s permission for a card transaction. The bank may decline without giving reasons.
- Bank — the credit institution serving the Payer, as well as the issuing or acquiring bank involved in the transfer.
- Agreement — the payment services agreement concluded between the Operator and the Payer by acceptance of the Terms.
- Operator — MAKS SISTEMLARI PLUS LLC, Azerbaijan, Baku, Azadlig ave. 70, apt. 118, AZ1106.
- Transfer — actions of the Bank and the Operator delivering the Payer’s funds to the Recipient.
- Transfer without an account — an operation performed on the Payer’s instruction without opening a bank account.
- Payment page — the interface on the Operator’s site where card details are entered and the instruction is submitted.
- Recipient — the legal entity, sole trader, individual or public authority in whose favour the payment is made.
- Payer — an individual making a payment who has accepted these Terms.
- Instruction — the Payer’s expression of will submitted to the Operator through the payment page.
- Recurring payment — periodic debiting in favour of the Recipient based on a single instruction.
- Service — the Operator’s arrangement of the information and technology interaction during a transfer.
2. How the service is provided
2.1. The Operator enables the Payer to create an instruction on the payment page and use the Service.
2.2. The Service is provided when all of the following apply: the Operator is technically able to provide it; authorisation has been received from the issuing bank; the service fee, if any, has been paid; no other restrictions set by the card-issuing bank apply.
2.3. The instruction specifies the amount, currency, card details, purpose of payment and Recipient details, plus the Payer’s contact details where the Recipient requires them.
2.4. Before confirming, the Payer verifies the parameters — above all the amount, currency and fee — and confirms them by pressing “Pay”, “Confirm” or an equivalent button.
2.5. The Payer may decline the Service at any time before confirming the parameters.
2.6. Where a fee applies, it is shown as a separate line on the payment page BEFORE confirmation.
2.7. A payment is deemed completed when the Operator receives authorisation confirmation from the bank.
3. Information security
3.1. The Payer takes their own measures to keep card details confidential and prevent third-party access to them.
3.2. The Payer uses a device with up-to-date software and antivirus protection.
3.3. Tools that distort or conceal connection characteristics, as well as automated access to the payment page without the Operator’s consent, are not allowed.
3.4. The Operator may suspend software and hardware for maintenance, fault clearance and prevention of unauthorised access.
3.5. The Operator complies with the PCI DSS standard and encrypts card details in transit. The full card number and the CVV code are not stored by the Operator.
3.6. The Operator takes measures to prevent unauthorised third-party access to information about the Payer’s transactions.
4. Obligations of the parties
4.1. The Operator undertakes to: provide the Service on the terms of this document; protect the data transmitted; report the result of the operation on the payment page and, where an e-mail address is given, by message; handle the Payer’s enquiries within the stated deadlines.
4.2. The Payer undertakes to: use only their own card or a card they are entitled to operate; provide accurate data; verify the parameters before confirmation; not use the service for operations prohibited by law.
4.3. The Operator may refuse the Service where a transaction raises suspicion of fraud or conflicts with the law or payment scheme rules.
5. Liability
5.1. The Operator is not a party to the transaction between the Payer and the Recipient and is not responsible for the quality, scope or timing of goods, works and services paid for through the service.
5.2. The Operator is not responsible for an issuing bank declining authorisation, nor for limits set by the Payer’s bank.
5.3. The Operator is not responsible for the consequences of the Payer disclosing card details to third parties.
5.4. The parties are released from liability in cases of force majeure, including failures of communication networks and power supply, acts of authorities and other events beyond the parties’ reasonable control.
5.5. In any event the Operator’s liability is limited to the fee it received for the specific transaction.
6. Enquiries and disputes
6.1. Enquiries are accepted at support@exezine.az. Please state the date and amount of the transaction, the last four digits of the card and the substance of the matter.
6.2. Enquiries are handled within 30 calendar days of receipt. Where a request to the bank or the Recipient is required, the deadline may be extended and the Payer is notified.
6.3. Refunds are made at the Recipient’s decision. The Operator performs the technical part and returns the funds to the same card used for the payment. Crediting times are determined by the issuing bank.
6.4. The complaint procedure is mandatory. Unresolved disputes are heard by the court at the Operator’s location under the laws of the Republic of Azerbaijan.
7. Final provisions
7.1. The agreement is effective from acceptance until the parties have fully performed their obligations.
7.2. The Operator processes the Payer’s personal data to the extent necessary to provide the Service, as described in the Privacy Policy.
7.3. The time of transactions is GMT+4 as determined by the Operator’s server data.
7.4. By accepting the Terms the Payer agrees to receive information messages related to their transactions. Consent to marketing messages is given separately and may be withdrawn at any time.
7.5. These Terms are drawn up in Russian. The Azerbaijani and English versions are provided for convenience; in case of discrepancies the Russian revision prevails.
